Terms and Conditions

1. Acceptance of these terms

By creating an account or using TracePoint (the "Service"), you agree to these Terms and Conditions. If you don't agree, don't use the Service.

2. What the Service does

TracePoint lets you install a tracking snippet on your website to attribute form submissions ("leads") to the marketing channel, source, medium, campaign, and landing page that produced them, and view that data in a dashboard.

3. Your account

You're responsible for the accuracy of the information you provide when creating an account, and for keeping your login credentials secure. You're responsible for activity that happens under your account.

4. Plans, pricing, and billing

TracePoint offers a Free plan and paid monthly plans (Starter, Growth, Agency), each with a monthly price and usage limits (number of sites, leads per site per month) as shown on our Pricing page. Paid plans are billed monthly in advance through our payment processor, Stripe. We don't currently offer annual billing or a free trial period. You can upgrade, downgrade, or cancel a paid plan at any time from your account's billing settings, which are managed through Stripe's billing portal.

5. Plan limits

Each plan limits how many sites you can track and how many leads can be recorded per site per calendar month. If a site reaches its monthly lead limit, additional leads submitted for the rest of that month are not recorded until the limit resets the following month or you upgrade your plan. This doesn't affect leads already recorded.

6. Acceptable use

You agree not to:

  • Use the tracking snippet to collect names, email addresses, phone numbers, or other message content from your forms — TracePoint is built to never store this, and modifying the snippet to do so is a misuse of the Service.
  • Attempt to bypass rate limits, plan limits, or access controls.
  • Use the Service in a way that violates applicable law, including data-protection and privacy law that applies to your own website and visitors.
  • Interfere with or disrupt the Service's infrastructure.

7. Your data

You retain ownership of the data associated with your account and sites. We process it as described in our Privacy Policy. If you configure a webhook, you're responsible for how you handle the lead data it delivers to your own systems.

8. Cancellation and termination

You can cancel a paid plan at any time through your billing portal; your account automatically moves to the Free plan once Stripe reports your subscription as canceled. You can also request deletion of your account from your account settings — this is reviewed and processed by our team rather than happening instantly, since it affects active subscriptions and historical data you may still need.

We may suspend or terminate accounts that violate these Terms, including the acceptable-use section above.

9. Service availability

We aim to keep the Service reliable but provide it "as is," without a guaranteed uptime commitment unless you have a separate written agreement with us that says otherwise.

10. Limitation of liability

To the maximum extent permitted by law, TracePoint and its team aren't liable for indirect, incidental, or consequential damages arising from your use of the Service, including lost leads, lost revenue, or lost data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

11. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above; continued use of the Service after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Canada, without regard to conflict-of-law principles.
